
Form W-8BEN: proving you are not a US taxpayer.
W-8BEN is not filed with the IRS. It is given to the US bank, broker, platform or client paying you, and it does two things: certifies that you are a non-US person, and claims the reduced withholding rate the US-UK treaty allows.

Without it, 30% comes off the top
US payers must withhold 30% from payments to foreign persons unless they hold a valid certificate. With a correctly completed W-8BEN, the treaty rate applies instead — typically 15% on dividends and 0% on most interest and royalties for UK residents.
Part II is the part people leave blank. Claiming the treaty rate means naming the country, citing the article and rate, and giving a US or foreign taxpayer identification number. An incomplete Part II means full withholding, whatever the treaty says.

Where it goes wrong
The common failures are avoidable: a US mailing address triggering US-person presumption, an expired form nobody renewed, a treaty claim without an identification number, or a US person signing one at all — if you are American, the correct form is W-9, and signing a W-8BEN is a false certification.
Where withholding has already been over-taken, the money is not lost. It comes back through a Form 1040-NR for the year in question.

Only give it to a genuine payer. Unsolicited requests for a W-8BEN by email are a common phishing pattern.
Through the end of the third calendar year after signing, so a form signed in 2026 runs to the end of 2029.
It lapses earlier if your details change - a new address, a change of citizenship or residence - and a lapsed form means 30% withholding resumes.
Form W-9, not W-8BEN. US citizens are US persons for this purpose wherever they live.
Signing a W-8BEN as a US citizen is a false statement to the payer, and it is one of the ways accidental Americans get into difficulty.
File the corrected W-8BEN so future payments are right, then reclaim the excess on a Form 1040-NR for the year concerned.
Refund claims are time-limited, so old over-withholding is worth reviewing sooner rather than later.
